Welcome to Shift-e. These Terms of Service ("Terms") govern your use of our tutoring business management application and services. By accessing or using Shift-e, you agree to be bound by these Terms.

Acceptance of Terms

By downloading, installing, accessing, or using the Shift-e application, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy.

Description of Service

Shift-e is a comprehensive tutoring business management platform that provides tools for:

  • Scheduling and managing tutoring sessions
  • Managing tutor and student profiles
  • Tracking performance and analytics
  • Communication between tutors, students, and administrators
  • Payment processing and invoicing
  • Generating reports and insights

User Accounts and Registration

To use certain features of Shift-e, you must register for an account. When creating an account, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Maintain the security and confidentiality of your login credentials
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use of your account

User Requirements

To effectively use Shift-e, please ensure that:

  • You are an admin before attempting to manage sessions
  • Your tutors have been added to Shift-e before linking them to sessions
  • Your clients have been added to Shift-e before linking them to sessions
  • You provide accurate login credentials (email address and password)
  • You have a stable internet connection for optimal performance

How to Use Shift-e

Adding Sessions

  1. Click on the plus sign at the bottom right of the home page
  2. Fill in the necessary details, including the date, subject, start time, end time
  3. Select a customer and tutor from the dropdown lists
  4. Click on 'Add session'

Troubleshooting Login Issues

If you're having trouble logging in:

  1. Ensure your username (email address) and password are typed correctly
  2. Check for spaces before your username or password
  3. Try resetting your password
  4. If issues persist, uninstall and reinstall the app
  5. Contact our support team if problems continue

Acceptable Use

You agree to use Shift-e only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the service for any illegal or unauthorized purpose
  • Violate any laws in your jurisdiction
  • Transmit any harmful, threatening, abusive, or defamatory content
  • Attempt to gain unauthorized access to the service or other users' accounts
  • Interfere with or disrupt the service or servers
  • Use the service to spam or send unsolicited communications

Intellectual Property

The Shift-e application, including all content, features, and functionality, is owned by Shift-e and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the application for your tutoring business purposes.

Payment Terms

For paid subscription plans:

  • Subscription fees are billed in advance on a monthly or annual basis
  • All fees are non-refundable except as required by law
  • You may cancel your subscription at any time
  • Price changes will be communicated with 30 days advance notice
  • Failed payments may result in service suspension

Apple App Store Terms (iOS)

For users who download Shift-e from the Apple App Store, the following additional terms apply:

  • This license is limited to a non-transferable license to use the application on any Apple-branded products that you own or control
  • Apple has no obligation to furnish any maintenance and support services with respect to the application
  • Apple is not responsible for addressing any claims relating to the application or your possession and/or use of the application
  • Apple and Apple's subsidiaries are third-party beneficiaries of these Terms
  • Upon your acceptance of these Terms, Apple will have the right to enforce these Terms against you as a third-party beneficiary

Data and Privacy

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using Shift-e, you consent to the collection and use of your information as described in our Privacy Policy.

Disclaimers and Limitation of Liability

Shift-e is provided "as is" without any warranties, express or implied. We do not guarantee that the service will be uninterrupted, error-free, or completely secure. To the maximum extent permitted by law, we disclaim all liability for any damages arising from your use of the service.

Termination

We may terminate or suspend your account and access to the service at any time, with or without cause, and with or without notice. You may also terminate your account at any time by contacting us or through the account settings in the application.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes via email or through the application. Your continued use of Shift-e after such changes constitutes acceptance of the new Terms.

Governing Law

These Terms are governed by and construed in accordance with the laws of South Africa, without regard to its conflict of law principles.
